'Chook' Fowler case adjourned after judge 'stuffed it up'

A FORMER rugby league player has had his court case adjourned because one magistrate "stuffed it up" - according to another magistrate.

Anthony Stuart "Chook" Fowler, 42, was due to have his case finalised today for offences including breaching bail conditions and breaching a suspended sentence, but Brisbane Magistrates Court heard the magistrate who dealt with his case last month and accepted his guilty plea made an error.

Today, Magistrate Stuart Shearer said the matter had to go back to that magistrate.

He also said the way the matter proceeded was "stupid".

The court heard Fowler was accused of breaching bail between March 19 and April 12 this year.

The court also heard he was accused of breaching a suspended sentence.

Fowler faced court last month and his case was adjourned to today because the court needed necessary transcripts to proceed.

Fowler was fined $600 last month but Magistrate Shearer said the sentence had not yet been officially finalised.

"Effectively the sentence hasn't finished, it's still part heard," he said.

He said the matter should go back before the original magistrate, but that magistrate was in an acting position and it was unclear when he would be behind the bench next.

"He stuffed this up," Magistrate Shearer said.

He said the sentence should have been declared "part heard" and adjourned.

The court also heard the transcripts had not been organised.

The case was adjourned to June 13 at Brisbane Magistrates Court.

Lawyers were asked to find out when the acting magistrate would be sitting next. - ARM NEWSDESK
